Terms of Service
These terms are the agreement between you and Messaging.Quest (Messaging Quest, “we”, “us”). By creating an account or using the service, you agree to them. If you are using Messaging.Quest on behalf of a company, you confirm you are authorised to accept these terms for it.
1. What Messaging.Quest does
Messaging.Quest helps you run B2B cold outbound. You paste a website; our agents research companies that fit your product, find a public business contact for each, draft a personal first message, register and authenticate sending domains for you, and — once you approve — send at a safe pace and route replies back to you. It is a tool you direct. You make the decisions: what to approve, when to launch, and to whom you reach out.
2. Your account
You must give accurate information, keep your login secure, and are responsible for everything done under your account. You must be at least 18 and legally able to enter a contract. One person or company per account unless we agree otherwise.
3. Acceptable use and your responsibility for outreach
You may only use Messaging.Quest for legitimate B2B outreach that follows the law and our Acceptable Use Policy. That policy is part of these terms. In particular, you are the sender: you are responsible for having a lawful basis to contact each recipient, for the accuracy and honesty of your messages, and for compliance with the anti-spam and data-protection laws that apply to you and your recipients (for example GDPR and the ePrivacy rules in the EU, CAN-SPAM in the US, and CASL in Canada).
We build the product to earn inbox placement rather than evade filters — authenticated domains, verified addresses, paced sending, honoured opt-outs. You agree not to work around those safeguards, and we may pause or stop sending that puts deliverability, recipients, or our providers at risk.
4. Your content and data
You keep ownership of the data you bring or generate — your company profile, contact lists, and messages (“your content”). You grant us the licence needed to host and process your content so we can provide the service (research, verification, copy generation, sending, reply routing, and support). You confirm you have the right to provide any contact data you upload and to contact the people on it.
How we handle personal data — yours and that of the business contacts in a campaign — is described in our Privacy Policy.
5. Plans, billing, and renewal
Research and campaign previews are free and need no card. Paid plans (billed monthly or quarterly through our payment processor, Stripe) begin when you launch a campaign and renew automatically each period until you cancel. Prices are shown at checkout; taxes may apply. You can cancel anytime from the billing portal — see the Refund Policy for what happens to the current period.
Sending domains are billed separately at the registrar’s cost (charged to your registrar balance, not part of the plan). Domain registrations are final once registered.
6. Third-party services
Messaging.Quest runs on third-party providers (hosting, database, payments, email delivery, domain registration, email verification, and AI models). Using Messaging.Quest means your content passes through them as needed to deliver the service. They are listed, with their role, in the Privacy Policy.
7. Intellectual property
We own Messaging.Quest — the software, design, and brand. These terms don’t transfer any of that to you beyond the right to use the service while your account is in good standing. You own your content; we own nothing you create in it.
8. Suspension and termination
You can stop using Messaging.Quest and close your account anytime. We may suspend or terminate an account that breaches these terms or the Acceptable Use Policy, creates legal or deliverability risk, or fails to pay. Where practical and lawful we will give notice first. On termination your right to use the service ends; you can export your content beforehand, and we retain and delete data as described in the Privacy Policy.
9. Disclaimers
Messaging.Quest is provided “as is”. Cold outbound depends on many things outside our control — your product, your market, mailbox providers, and how recipients respond — so we do not guarantee deliverability, replies, meetings, or revenue. We work hard to keep the service available but do not warrant it will be uninterrupted or error-free.
10. Limitation of liability
To the extent the law allows, Messaging.Quest is not liable for indirect, incidental, or consequential losses (including lost profits, data, or goodwill). Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law.
11. Indemnity
You agree to cover us for claims, losses, and costs arising from your use of Messaging.Questin breach of these terms or the law — including outreach you send without a lawful basis or content that infringes someone’s rights.
12. Changes to these terms
We may update these terms as the product and law evolve. If a change is material we will give reasonable notice (for example by email or in-app). Continuing to use Messaging.Questafter a change takes effect means you accept the updated terms.
13. Governing law
These terms are governed by the laws of Portugal, and the courts of Portugal have jurisdiction over any dispute, without prejudice to any mandatory consumer protections available to you where you live.
